First Amendment in the 21st Century

The US Supreme Court has agreed to hear arguments on whether or not threatening comments made on social media should be considered free speech or a criminal threat.

The case centers around a pennsylvania man who spent more than three years in prison after he was convicted of making threats on Facebook.

In 2010, Anthony Elonis posted rants about killing his estranged wife,  law enforcement officials and others often in the form of rap lyrics.

Elonis argues he never intended to carry out the threats, and that the comments are protected speech under the first amendment.

The high court is expected to arguments later this year.
