Court Rules On Health Insurance For State Retirees

The Sangamon County Circuit Court has ruled health insurance for state government retirees is not a right under state law.


Judge Steve Nardulli said healthcare isn't considered a pension benefit in the state's constitution. That's why he threw out a suit challenging the state law that eliminates free or reduced-cost health insurance for retirees.


A retired state judge filed the lawsuit after the governor signed a law requiring state employees, lawmakers, and judges to start paying for their own healthcare premiums.


Gov. Pat Quinn called the decision "good news" for taxpayers.


In a statement, Senate President John Cullerton said, "It reinforces my position that a guarantee of healthcare access can be negotiated as part of a contractual change to protected pension benefits."


Lawmakers could vote on pension reform as early as this week.
